Understanding Your Legal Obligations as a Landlord”
Becoming a landlord comes with more than just the promise of monthly rental income. It also comes with a series of legal obligations that, if ignored, can result in fines, disputes, or even criminal penalties. Whether you’re a first-time landlord or managing multiple properties, staying informed is non-negotiable.

1. Safety Responsibilities
Gas Safety Certificate (CP12)
You must ensure that a qualified Gas Safe registered engineer inspects all gas appliances annually. A valid certificate must be provided to tenants.
Electrical Installation Condition Report (EICR)
Since July 2020, all rented properties must have a valid EICR every 5 years. Any urgent work flagged must be addressed within 28 days.
Fire Safety
Smoke alarms: Install on every floor.
CO alarms: Required in any room with a solid fuel-burning appliance.
Fire escape routes: Should be accessible and unobstructed.
2. Right to Rent Checks
Landlords must check that all adult tenants have legal status to rent in the UK.
You must:
Verify original documents in person
Make and keep copies
Re-check documents when visas or permits expire
Failure to do so can result in significant fines.
3. Deposit Protection
Landlords in England must protect a tenant’s deposit using a government-approved scheme (e.g. DPS, MyDeposits, TDS) within 30 days.
You must also provide tenants with:
Prescribed information
Tenancy agreement

Failure to comply may:

Lead to compensation of up to 3x the deposit amount
4. Energy Efficiency
Properties must meet a minimum EPC rating of E or higher to be legally let.
From 2025, new rules may tighten this requirement, so proactive upgrades now could save you trouble later.
